This Cancellation Policy governs your use of our website (“Website”, or “Service”) operated by Property Portfolio and/or Softmark Realty Solutions (“us”, “we”, or “our”). Please read this Policy carefully before using our Service. This Policy should be read in conjunction with our Terms and Conditions and with our Refund Policy which are also found on our Website. By accessing any areas of the Website, you agree to be bound by this Policy.
SUBSCRIPTION MODELS
There are 2 subscription models:
- A monthly subscription paid in advance
- A yearly subscription paid in advance at a cheaper price than the monthly rate
Your payment will be processed through our payment gateway service administered by third parties with whom we have a contractual relationship, which serve to validate your payment. Upon registration for subscription and upon payment, you are therefore giving your consent that your credit card details may be accessed by the payment gateway service provider for the purposes of the validation of payment as per their Terms and Conditions.
To enable your subscription, you should provide valid credit card details, and to enable us to ascertain card verification, an amount of €1 will be preauthorized by yourself. The accepted payment method is through MasterCard and Visa credit cards. Additional charges may apply to credit card payments but we are not responsible for these additional charges that your bank may apply. Subscription fees will be billed in advance at the beginning of your subscription or on every automatic renewal. Unless we state in writing otherwise, all fees and charges are nonrefundable.
We may change the fees and charges then in effect, or add new fees or charges, or vary the term of the subscription by giving you thirty days (30) notice in advance. You are entitled to terminate your Subscription in line with this Agreement within the duration of the notice period.
SUBSCRIPTION TERMS
When you register for the subscription, the price of your subscription will be as indicated on the website and will be for the period of time indicated in the respective subscription form.
- Monthly Subscription: Renewed automatically every month unless cancelled by the user as per the refund policy.
- Yearly Subscription: Renewed automatically every year unless cancelled by the user as per the refund policy.
Both monthly and yearly subscriptions may offer a free trial period. All new users can benefit from this upon presentation of their ID Card number and mobile number in the sign up process.
CANCELLATION NOTICE PERIOD
- Monthly Subscription: Users can cancel at any time. Nevertheless, the cancellation will take effect at the end of the current billing cycle. No pro-rata refunds will be given for partial months.
- Yearly Subscription: Users may cancel at any time. Nevertheless, the cancellation will take effect at the end of the current billing cycle. Pro-rata refunds may be offered based on the number of months remaining in the subscription, excluding any discounts provided from the normal monthly rate.
We reserve the right to refuse refunds.
Early Termination Fees
- Monthly Subscription: No early termination fees.
- Yearly Subscription: If a pro-rata refund is given, an early termination fee might be deducted. A €100 (excl. VAT) fee to cover administrative costs is charged, and any discounts provided for annual subscriptions to be revoked.
Process for Cancellation
- Online Cancellation
- Users can cancel their subscription through their account settings on the platform.
- A confirmation email is sent to acknowledge the cancellation request. Should the email confirmation not be received, the user retains responsibility to confirm with us the validity of the cancellation within 15-20 days’s time. Should the cancellation not have been affected and you are still charged, we may offer a refund for that billing cycle.
- Customer Support Cancellation
- Users can contact customer support to request cancellation.
- Customer support will guide users through the cancellation process and send a confirmation email once completed. Should the email confirmation not be received, the user retains responsibility to confirm with us the validity of the cancellation within 15-20 days’ time. Should the cancellation not have been affected and you are still charged, may offer a refund for that billing cycle.
We do not accept any other form of cancellations.
Impact of Cancellation
- Access to Listings
- Upon cancellation, the user will retain access to their listings and leads until the end of the current billing cycle.
- After the billing cycle ends, listings will be removed from the platform, and access to leads will be revoked.
- Data Retention
- Users will have the option to export their data (e.g. listing details, leads) before the cancellation takes effect. The business is not responsible for any data loss or alteration.
- No personal data that we process will be kept longer than necessary for the purposes for which it is processed.
- Any and all social media posts made for the listings or agents or agencies during the period of their subscription will not be removed or altered and can be used for repurposing content and marketing efforts throughout our social media, website, blogs, and so on.
Automatic Renewal and Reminders
Your subscription will continue indefinitely and renew automatically, unless it is cancelled or opted out from in accordance with our Cancellation Policy.
For all subscriptions, you must cancel your subscription before it renews and therefore before your next billing date in order to avoid billing of subscription fees for the following renewal term. The onus is upon you to cancel your subscription before the due date if you do not wish to renew. Cancellation will apply once duly confirmed via email.
- Notification of Renewal
- Users will receive a notification email thirty (30) days before the annual subscription renewal date.
- Monthly subscribers will receive a notification seven (7) days before the renewal date.
- Opt-Out of Automatic Renewal
- Users can opt out of automatic renewal at any time through their account settings.
- The platform will confirm the opt-out request via email.
Default in Payment
If you default in one payment that has become due, we reserve the right to cancel your subscription immediately without notice and without prejudice to our right to recover from you any outstanding amount due by you to us.
Free listings
Should there be an offer for free listings, we reserve the right to change the conditions as we wish without prior notification.
Assignment
You may not transfer, assign, or otherwise dispose of any of your rights or obligations arising from your subscription with us without our prior written consent. For the avoidance of doubt, you are not permitted to sell on or transfer the benefit of your subscription services to third parties. We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under your subscription
Limitations on Use
Only one individual may access a subscribed service at the same time using the same username or password, unless we agree otherwise.
Limitation of Liability
We will not be held liable for any issue and problems that give rise to temporary interruptions from the use of our services arising from factors beyond our control, such as, but not limited to, traffic congestion on the internet.
GOVERNING LAW AND SEVERABILITY
This Policy shall be governed and construed in accordance with the Laws of Malta. Both the user and us submit to the exclusive jurisdiction of the Maltese Courts.
If any part of this Policy is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
WAIVER
The waiver by us of a breach or default by the user of any of the provisions of this Policy shall not be construed as a waiver of any succeeding breach of the same or other provisions nor shall any delay or omission on our part to exercise or avail ourselves of any right, power or privilege that it has or may have hereunder operate as a waiver of any breach or default by the user.
